TRACY MORGAN: Walmart Blaming the Comedian for His Injuries

Walmart is blaming Tracy Morgan for the injuries he suffered in that six-car accident earlier this year -- because he wasn't wearing a seatbelt.

In June, the comedian's tour bus was hit by a Walmart truck on the New Jersey Turnpike, killing his friend Jimmy Mack and seriously hurting others in the vehicle. Now in new legal papers, the company claims that Tracy's injuries "were caused, in whole or in part, by [his] failure to properly wear an appropriate available seatbelt restraint device."

Tracy, who had been hospitalized with numerous broken bones, is among several people suing Walmart for negligence after it was learned its driver may not have slept for more than 24 hours before the accident. Driver Kevin Roper has been charged with one count of death by auto and four counts of assault by auto.
