According to court documents filed late Tuesday, Mechelle McNair has asked the Davidson County Probate Court to dismiss a $1,750 claim filed by Gianikas Property Management early last month because the co-signer form and lease were not signed together. The lease agreement was signed on Oct. 14, eight days after Steve McNair signed the co-signer form. Also, Steve McNair's signature does not appear on the property lease, court documents said.

Gianikas "drafted the Lease and is therefore responsible for and aware of the language clarifying that only agreements executed simultaneously with the Lease shall be included as part of the Lease," Mechelle McNair's filing said. "The only document containing the signature of the Deceased is the Co-Signers Form, which makes no reference to the Lease and was not executed simultaneously therewith.

"As a result, the Co-Signers Form is not part of the Lease, and the only party obligated under the Lease is the Resident."
Steve McNair's cousin, Raymond White, was listed as the primary renter for the condo on Parthenon Avenue near Centennial Park.

VANDERBILT THEIVES CAUGHT ON TAPE...IS THIS YOUR COUSIN?

Metro Police are helping Vanderbilt look for laptop thieves. There have been several on the Vanderbilt campus, and a couple of the thieves have been captured by video surveillance cameras. Vanderbilt police said the crime was Sunday, August 9 at 12:20 p.m. The video came from cameras at the Stevenson Center on the college campus. Police said the two men stole a laptop computer.

"They knew exactly where to go, and they went directly to an open office," said Mark Hallman, Vanderbilt Police Department. Police said an hour earlier one of the men was spotted taking another computer.

THE NASHVILLE PANERA BREAD BOOTY SLAPPER

Awny Basta, 42, of Rice Road, was taken into custody Tuesday night and has been charged with three counts of sexual battery, two from this year and one from 2008, for grabbing the buttocks of several women on separate occasions at Panera Bread on West End Avenue. Basta was taken into custody Tuesday night and during questioning, police said he admitted to fondling multiple women, but did not provide further details.

Two women allegedly grabbed by Basta have identified him from a photo lineup and a third victim has given a physical description that matches Basta, police said. Basta was convicted in 2006 of attempted sexual battery against a 33-year-old woman at the Rivergate Panera Bread store.

JUSTIN TIMBERLAKE GOING INTO RETAIL

Justin Timberlake is going into the retail biz, taking his William Rast clothing line directly to the people next month. J-T is opening three California stores, including an outlet selling the goods at discount prices. C-E-O Colin Dyne tells the Los Angeles Times that Justin and his partners plan to open between 40 and 50 stores over the next couple of years, with Timberlake's home state of Tennessee due for a location soon.

NEW FED STUDY REVEALS MINFROTIES DENIED CREDIT MORE

When applying to refinance, black and Latinos were far more likely than non-Hispanic whites to be denied last year, according to a Federal Reserve report on home mortgage data. It found the denial rate for blacks or African-Americans was 61-percent. That compares with 51-percent for Latinos and 32-percent for whites. The gap may partly reflect the bigger number of minority borrowers who got subprime loans during the housing boom and ended up in homes whose values have crashed. The feds also say some of the difference may have to do with borrowers' overall debt burdens in relation to income and credit records.
