There Is A Petition Going Around to put Timothy Batts back in jail...#SMH

HENDERSONVILLE, Tenn. (WKRN) – An online petition is asking the father accused of shooting his 11-year-old daughter be put back to jail. It’s already gotten hundreds of signatures.

Timothy Batts posted bond Friday, Aug. 12, but he allegedly tested positive for cocaine just three days after his release.

The petition asks that the judge revoke his bond because of the failed drug test.

But the petition won’t likely sway the judge; there’s a law protecting Batts from going back to jail right away.

Tennessee Code 40-11-243 says there has to be a “time reasonable under the circumstances” for the defense and prosecution to prepare when allegation, like testing positive for drugs, is made.

“Typically in Tennessee that’s five days,” says criminal defense attorney David Raybin. “That’s fast for anything in criminal court.”
