*NASHVILLE, Tenn. - The man police said sexually assaulted a 3-year-old girl in the bathroom of a local thrift store appeared before a judge Tuesday. Diego Armando Rosales is charged with aggravated kidnapping. Police said he did not know the victim.The incident happened in September at the Music City Thrift Store in South Nashville. Man Accused Of Sexual Assault On Toddler Surveillance video shows Rosales grabbing the little girl and carrying her into the store's restroom, where he sexually assaulted her. Minutes later, he was seen running out of the restroom followed by the little girl - who came out screaming.The judge turned the case over to the grand jury.


"Teachers Learn To Integrate Technology"




*NASHVILLE, Tenn. - Educators from across the state will be in Nashville Wednesday for the 27th Annual Tennessee Educational Technology Conference. Wikipedia co-founder Larry Sanger has been scheduled to speak at the event. Sanger recently launched a new web site designed to gather videos and tools for students to use in the classroom. By attending the conference, educators will learn how to integrate more technology into their everyday curriculum.



"Parents File Lawsuit Against Metro For Daughter's Murder"




*NASHVILLE, Tenn. - The parents of a mother of three, who was murdered by her estranged boyfriend, filed a multi-million dollar lawsuit against Metro. Steven and Kathy Albright claim their daughter's death could have been prevented. Police said Michael Williams killed Shellie Hernandez on Dec. 2, 2008, just one day after he got out of jail for violating a restraining order she had against him. In a lawsuit filed against the city the Albrights claim Williams was let out of jail because his probation officer failed to say he had violated his parole on another domestic violence conviction. Williams is slated to face trial for the Hernandez's murder in July 2010.



"HIV Victim Speaks Out On World AIDS Day"




*NASHVILLE, Tenn. - After more than a year of dating the same man, Sherree Amos found he did not share a life changing secret with her that turned her life upside down. It was November 6, 2008 when Amos found out she was HIV positive. The woman her boyfriend was cheating with told her she was positive and so was Amos's boyfriend. After being tested, she found out her status and more news. "I was not his first victim," said Amos. "He's actually been to jail for [infecting a woman] before."


The man who infected Amos is serving time in a Tennessee prison and is now a registered sex offender. The largest group of new cases of HIV and AIDS are African American woman, but there are other populations were doctors are seeing a growing number of newly infected, children and older adults. "We are seeing HIV show up in kids in the 4th and 5th grades, which is devastating," said Dr. James Hildreth, Director of the HIV Research Center at Meharry Medical College. "We're also seeing it in people who are 60 years old and older." Dr. Hildreth said the biggest challenge is getting people to realize anyone can be infected with the virus. He said this is sometimes a challenge for certain groups because of the success there has been in finding treatments helping people live long lives with HIV. "It comes down to communicating and having messages appropriate for that age group," said Hildreth. Getting tested is one way to prevent the spread of HIV and AIDS. Hildreth said when more people know, they can inform others of their status and people can take better precautions in protecting themselves. In Middle Tennessee, there is an average of 370 new cases of AIDS and HIV reported each year, with African Americans and Hispanics representing 51 percent of new cases. Amos said her new life mission is to educate the misinformed. "Everybody needs to be educated," said Amos. "That's one of the reasons I am infected because I was not educated. The knowledge and information is out there, but we don't utilize it."

"Judge Rules Accused Serial Killer Interview Allowed"




*NASHVILLE, Tenn. - A judge ruled Tuesday that a crucial piece of evidence in the case of accused serial killer Bruce Mendenhall will be allowed during his trial. A taped interview with Metro Police Detective Pat Postiglione just hours after his 2007 arrest in Nashville will be allowed in court. Mendenhall is accused of killing at least seven prostitutes, two in the mid-state. He told detectives during the interview that two men were killing the women with his gun and then dumping the bodies in his truck. Police Interview Tape Released Of Bruce Mendenhall Mendenhall's attorneys claimed the detectives violated his constitutional rights that day, and asked that the interview be thrown out.

"Starved horses get attention of lawmaker"



*State Rep. Janis Sontany of Nashville moved down the stalls one by one at the Tennessee State Fairgrounds on Tuesday, looking over 82 boney, near-starved horses and two mules. Manes hung matted with cockleburs. Dehydration, misshapen hooves and wounds were evident. One young mule, too weak to be revived, had died two days ago. Two Cannon County men, from whose farm the animals were removed from last week, face misdemeanor charges. Such horrific treatment of horses, or any confined animal, should be a felony, Sontany said, like it is when a dog or cat is abused. She said she intends to file a bill in the coming legislative session to try to make it so.


"We no longer should give anyone a pass if they hold back food and water," Sontany said. Farm animals were not included when a bill that addressed dog and cat abuse passed the legislature because of objections from farming community representatives, she said. In this case, Charles Eugene (Gene) Howland and his son, Charles C. (Clint) Howland are scheduled for a court appearance Tuesday on misdemeanor animal cruelty charges, according to Cannon County Sheriff Billy Nichols. They are free on $1,500 bond each. The district attorney is expected to file more charges, with evidence that the nonprofit groups taking care of the animals say they have gathered to document the neglect.The Humane Society of the United States, working with United Animal Nations,estimates the cost of the rescue and work will run about $250,000, for which fundraising is needed. Nichols thanked the groups and volunteers for taking on the grim rescue and recovery that was too large and pricey for his department alone. About 40 horses were found last week inside a barn in atrocious condition, said Cannon County Detective Charlie Wilder. Urine and manure lay so thick that he sank past his boots in it, he said. Ammonia stank so much, his lungs hurt. "One dead horse was lying among the live ones," he said. Other horses had been confined outside in an area with not enough grass for grazing, Sontany said. "What do you think the outcome is going to be if you do that?" she asked.

*He wants to start the deployment quickly -- within six months -- with a goal of beginning a pullout in mid-2011 and having most troops out by 2013. Some highlights of the speech: Obama called Afghanistan and Pakistan "the epicenter of the violent extremism practiced by al Qaeda." He rejected parallels to Vietnam, noting that we have a broad coalition of allies, that the insurgency isn't popular in Afghanistan and that we were attacked from Afghanistan. His goals are to "deny al Qaeda a safe-haven...reverse the Taliban's momentum and deny it the ability to overthrow the government...and strengthen the capacity of Afghanistan's security forces and government." In conclusion, the president insisted, "It is easy to forget that when this war began, we were united -- bound together by the fresh memory of a horrific attack, and by the determination to defend our homeland and the values we hold dear. I refuse to accept the notion that we cannot summon that unity again." Republicans were generally supportive, though most questioned the president's 2013 deadline. Democrats were split, with many asking whether more troops is the answer to defeating the Taliban and al Qaeda.



"District of Columbia Council passes gay marriage bill"




*Reporting from Washington - The District of Columbia Council took a major step Tuesday toward joining New Hampshire, Connecticut, Iowa, Vermont and Massachusetts in legalizing same-sex marriage. In the first of two votes, the council passed a bill 11 to 2. Although the outcome was expected in the heavily Democratic city, the move remains controversial because of opposition from socially conservative churches. "Today's vote is an important victory not only for the gay and lesbian community, but for everyone who supports equal rights," Councilman David A. Catania, who is gay, said in a statement. "Gays and lesbians bear every burden of citizenship and are entitled to every benefit and protection that the law allows." The most vocal opposition came from the Catholic Archdiocese of Washington. Archbishop Donald W. Wuerl has warned that legalizing same-sex marriage would force the church's social services arm to scale back its efforts in the city. The law, as passed Tuesday, would not make churches perform same-sex marriage ceremonies, but it would require employers doing business with the city, including churches, to provide health benefits for married same-sex couples. Church officials said that providing those benefits would violate their religious beliefs. "We really don't want to be in a position where we're being asked to abandon one part of our faith to be able to live out the other part," said Susan Gibbs, an archdiocese spokeswoman. "Our goal is to be able to provide the same level of services, but we have to be true to our faith." Gibbs said the archdiocese was trying to work out a compromise allowing it to continue receiving city money to help provide social services, but exempting it from recognizing same-sex marriages. In order to legalize same-sex marriage, the council must vote again to pass the bill, which is expected to occur Dec. 15. Once it is signed into law by Mayor Adrian M. Fenty as expected, it will be sent to Congress for review. If Congress takes no action to block the law within 30 legislative days, same-sex marriage would become legal. District politicians were optimistic that would happen. "All the indications have been that they won't do anything," said Doxie McCoy, spokeswoman for council Chairman Vincent C. Gray.

This time the sting operation went down at a place in Mobile, AL called A Spot of Tea -- which turns into a nightclub called Club Insanity. According to the lawsuit, agents working for ASCAP -- an enforcer of music royalties -- observed the bar rocking out all sorts of tunes they're not allowed to play, including: - Mary Jane by Rick James - Erotica by Madonna - Rock With You by Michael Jackson - Umbrella by Rihanna and Jay-Z Now Jay-Z, along with the publishers of the other songs, wants the Tea-bags to pay up.

*So much for that Jennifer Lopez sex tape. J-Lo's first husband, Ojani Noa, has been trying to release footage from their honeymoon video, which allegedly contains Lopez in sexual situations. But her lawyer, John Lavely, tells People magazine, "There wasn't anything close to sex in it. We never alleged that. But it's still private and personal to my client." An L-A judge agreed, upholding a ruling that bars Noa from using the 11-plus hours of home video for a mockumentary about his life.

*Nicole Richie is going from reality T-V to scripted T-V. She's reportedly developing an A-B-C sitcom in which she'll star and produce. On her website, Richie writes, "The story revolves around a young, modern and professional woman who must balance her business and family relationships. She must deal with, and navigate the many ideas of what a woman's role is -- modern vs. traditional."


"TIGER WOODS GETS OFF WITH TRAFFIC TICKET"




*There will be no criminal charges brought against Tiger Woods, a Florida Highway Patrol spokeswoman said yesterday. Instead, he'll be issued a minor traffic ticket for that one-car crash outside his Orlando, Florida home. If found guilty of the careless-driving citation, he could be fined 164-dollars and receive four points on his license. Police also said there were no claims of domestic violence in the case and "there was insufficient evidence available to issue a subpoena for additional medical information that may exist." But Tiger isn't out of the woods with the tabloids just yet. Another woman has been romantically linked to the golfer. Jaimee Grubbs tells Us magazine that she had a 31-month fling with Tiger and has a voicemail recording and more than 300 steamy text messages to prove it. Grubbs recently appeared on V-H-1's Tool Academy. Rachel Uchitel, the first "other woman" romantically linked to Tiger, denies having a sexual relationship with the married golf pro. With no video of the mysterious crash, a Taiwanese news program did the next best thing -- they created a re-enactment using virtual actors. The highlight of the hilarious video comes when a virtual Elin Nordegren chases Tiger's S-U-V swinging a golf club.

"Aluminum Can Tabs Still Pose Health Risks Researchers Say Changes in Design Haven't Prevented Accidental Ingestion"



*The aluminum can manufacturers' move to make the tabs on cans harder to ingest is apparently too easy to swallow. The so-called stay-tabs were developed to prevent accidental ingestion of the pull-tabs that preceded them. But young people are still swallowing them, says Lane F. Donnelly, MD, director of biodiagnostics at Cincinnati Children's Hospital Medical Center. If you fiddle with the stay-tab, it can easily break off," he said, while demonstrating how the tabs are easily separated from the cans with a couple of twists."Then, you may place it in the can, forget, and end up swallowing it," he tells WebMD. Swallowing foreign objects, be it a penny or a can tab, can injure the GI tract, causing bleeding or other problems. Surgery is sometimes required.About three decades ago, manufacturers began refitting beverage cans with the stay-tabs, after research showed that children were swallowing pull-tabs. One study revealed two cases of accidental ingestion and one case of aspiration after children swallowed pull-tabs that had been dropped into the cans.The new study, presented here at the annual meeting of the Radiological Society of North America (RSNA), suggests that the new tabs "have not reduced the number of ingestions,"


Donnelly says. Children Still Swallowing Stay-Tabs Donnelly and colleagues identified 19 cases of inadvertent stay-tab ingestion at Cincinnati Children's Hospital Medical Center from 1993 to 2009. "If we have 19 cases at one institution, it's probably a much bigger problem nationwide," he says.The children's ages ranged from 1 to 18 years. "We were surprised that most of them were teenagers," Donnelly says. Of the 19 cases in the study, only four of the stay-tabs could be spotted on X-rays. Donnelly showed a series X-rays, demonstrating how a penny that had been accidently ingested was easily viewed, but how it was nearly impossible to see the aluminum tabs.Connelly says that none of the 19 youths suffered breathing problems or vomiting or required further treatment. But there is always a risk of internal bleeding because of the sharp edges on the breakaway tabs, he says. There's also a risk of the tab causing obstructions, he says. One of the children was sent home with instructions "not to suck on can tabs" when drinking beverages."A better education campaign is needed," Connelly says. Joseph Tashjian, MD, president of St. Paul Radiology in Minnesota and moderator of a news briefing, says that the new tabs are "a substantial step forward" from the old pull-tabs. "They are rounded -- not as sharp," he says. With the original pull-tabs, surgery was sometimes required to remove the devices after accidental ingestion, he notes. Still, further research is needed to make them safer, Tashjian says. "We probably need some changes in can design -- cans that keep the tabs better attached," Donnelly says.
