Legal disputes entangle Metro school board member

Veteran Metro Nashville school board member Ed Kindall is embroiled in at least two legal disputes stemming from incidents involving his daughter, including owing money to an estate and an entertainment company, court records show.

In the cases, Kindall's daughter, Marjorie Tansil, is accused of acting on Kindall's behalf without his knowledge. Tansil works for her father, who is a lawyer. She is not.


The most recent filing, submitted last week, pertains to a dispute where Kindall, a school board member for more than 20 years, concurs he owes the estate of a late Metro school custodian.

The custodian, Fred Ezell, died in May and left about $140,000 to his family. Shortly after his death, Ezell's wife, Katherine, hired Kindall to handle the estate since there was no will, and the family claims they have not received any money. She fired Kindall, and a restraining order keeps him from using the estate account after a check they were given bounced, according to court records.

In court filings, Kindall claims he owes $58,551 to the Ezells.

"He has an accounting figure of what is owed, and I'm in the process of looking at that," said Katherine Ezell's attorney, Joy Sims. "We're just trying to recover what directly was in the estate account."

Kindall was unaware of the estate until the restraining order was issued in October, according to a court affidavit. He never met with the beneficiaries, was not involved in any transactions and will make the estate whole, according to the affidavit he filed.

However, court records show that Tansil was in contact with the Ezells and include photocopies of checks from the Ezells to Kindall. There is no record of where the money went or how it was spent.

Without naming Tansil, Kindall's lawyer, George Thompson III, said the discrepancy with the account stems from an employee stepping beyond his or her scope of duties but wouldn't elaborate. Kindall was unaware what the employee, who is not an attorney, had done, Thompson said.

"It's a very sensitive matter," Thompson said. "Ed Kindall will do his best and will rectify what happened."

In another case, Tansil is accused of fraud for claiming to do contract work and asking for a $40,000 investment from an entertainment company that looked to be represented by her father, according to court records. She received the money in October 2007 to "fund a play."

Kenneth Dozier, owner of Goodlettsville's Nairobi Café Theater and his cousin, Yvette Walker, are suing Tansil for breach of contract, fraud and misrepresentation among many other counts. Tansil cannot account for about $30,000 of that money, court records show.

Kindall and Tansil could not be reached for comment.
