12 Year Old Boy Shot While Carrying a Fake Gun

A 911 call came into dispatch saying, "It's probably fake, but you know what, it's scaring the [expletive] out of people."

When the police showed up, one of the officers saw 12-year-old Cleveland resident Tamir Rice, pick up “the pistol” sitting off of a table or bench and put it in his waistband.

According to Follmer, The cops had not been told the 911 caller thought the gun could be a fake. The Airsoft replica gun did not have the orange safety cap which lets everyone know that the gun is in fact a fake.

The 12 year old was ordered by the police to put his hands up. The boy then grabbed for his fake gun in his waistband.

Deputy Chief Ed Tomba said: "That's when the officer fired."

The child died the next morning from two gunshot wounds.

The Rice family hired attorney, Attorney Timothy Kucharski, who told the local TV station that "an innocent boy was shot and killed" by a rookie officer.

CBS News states that the two officers involved in the shooting have been placed on administrative leave, which is standard procedure. The Cleveland Plain Dealer reported that the other officer involved is a 10-year department veteran.

"This is not a black and white issue. This is a right and wrong issue. This is not a racial issue. This is about people doing their jobs the right way," said The Rice Family’s attorney.
